Terms of Use for Projectholic

These Terms of Use ("Terms") govern your access to and use of the Projectholic app ("App") provided by Feioustudio ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

Please read these Terms carefully before using the App. If you do not agree to these Terms, you may not use the App. We may update these Terms periodically; continued use of the App after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that you have parental or guardian consent. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account and Subscriptions

• Apple ID. The App uses your Apple ID for purchases and subscriptions. We do not create or manage user accounts.
• Billing. Subscriptions are processed through Apple. You are responsible for managing your subscription settings and payment details in your Apple account.
• Free trials. If a free trial is offered, you may cancel before the trial ends to avoid being charged.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful or fraudulent purpose.
• Reverse engineer, decompile, or attempt to extract the App's source code except where permitted by law.
• Interfere with or disrupt the App or the servers and networks connected to it.
• Use the App in a way that violates the rights of others.

5. User Content

• Your data. Project data, tasks, and other content you create remain yours. They are stored in your personal iCloud account.
• Responsibility. You are responsible for ensuring that your content complies with applicable laws and does not infringe the rights of others.
• Backups. We do not control or store your content. You are responsible for maintaining appropriate backups through iCloud or other means.

6. Intellectual Property

• The App and all content, features, and functionality (excluding your content) are owned by Feioustudio or its licensors and are protected by intellectual property laws.
• Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or internal business purposes.

7. Paid Services and Billing

• Fees for premium features or subscriptions are disclosed within the App and processed by Apple.
• All payments are final and non-refundable except as required by applicable law or Apple's policies.
• We reserve the right to change pricing; any changes will apply to new billing cycles and will be communicated through Apple.

8. Termination

We may suspend or terminate your access to the App if you breach these Terms or if we are required to do so by law. You may terminate your use at any time by uninstalling the App and cancelling any active subscriptions. Sections that by their nature should survive termination will remain in effect.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Feioustudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our systems; or (c) any other matter relating to the App.

11. Indemnification

You agree to indemnify and hold harmless Feioustudio, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your use of the App or violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Feioustudio is established, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes.

13. Changes to Terms

We may modify these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Your continued use of the App after the revised Terms have become effective indicates your acceptance of the changes.
